Can this mouse be used for gaming?

I love this mouse for work and home use but I wouldn't use it for anything more than a simple game. The wheel motion is not precise and sometimes the buttons get confused.

Does this mouse work with Window 8's touch interface?

As of right now, I don't know if it's touch interface will work with Windows 8. My gut tells me it will because (supposedly) a great many peripherals that worked on 7 will do so on 8. I know that Microsoft's Touch Mouse will be getting some tweaks in the software to take advantage of the Windows 8 layout, but that's about it.

Does this mouse work with Linux Ubuntu?

Is your touch mouse loose like mine? if you lift it slightly, it gives a bit. when you shake it, the insides moves. not solid. it's quite annoying.

Mine is solid and it does not rattle when I shake it. It sounds like you have a damaged one. You should return it and get another one. Make sure it's new and not a 'used' one. Hope this helps.
