Q: How tall is this hat?

4 3/4 inches. It's also 7" in diameter inside edge to inside edge.

Q: Since there is no size chart how do I know if this would accommodate a 7 3/8 head?

I don't know what that measures to,but the fez is fairly small and meant to fit a child, in my opinion.

Q: How does it stay on a childs head?

Depends on the child and depends on the head. It fit my 6 year old a little low, but he was thrilled with it. Just like wearing any hat, you have to modulate your activity level to keep it in place.

Q: Will the Fez hat be too big for a 5 year old

Yes, I think it would be too big for a small child. The hat was large on my adult head.
