how long is the inseam on these?

On a Small, more like 2-3". If you need an actual 5" inseam, you might try a 7" short in small.

Does it have an actual waistband? I bought Champion and there's no wasitband.

It has a very nice 2 1/2 inch waistband. The actual elastic is a 1/2 inch band inside and goes around the top of the waistband so there is no constriction.
