Is the material under the zipper snake proof if not zipped up?

NO, it is not. It is a part of the waterproof membrane, is flexible, but not a part of the snake-proof outer shell. Keep'em zipped!

Yes. They take breaking in. Took about three hours of wear. They were stiff and not flexible at first.
