Can this be used without the legs attached? Thinking of using it in my outdoor fireplace.

As long as the fireplace is large enough, allows enough airflow to the smoker (I doubt this will be an issue, but some styles might be a problem), and is large enough for you to open the door and manipulate everything inside then you should be fine. The legs are primarily a safer mechanism more than anything else.
